1. Introduction

By downloading, installing, or using Graphinger ("the App"), you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not install or use the App.

2. Nature of Service

Graphinger is an AI-powered graphics studio app that provides:

Business and personal graphics templates
Multiple branding frames for applying logos and watermarks
Custom image branding frame creation
AI photo prompts to inspire promotional content creation
Daily graphics updates and event-based notifications

Important: Graphinger is a creative tool. You are responsible for how you use the graphics, branding frames, and AI prompts generated through the App.

3. Account & Usage

3.1 Eligibility

You must be at least 13 years old to use Graphinger.
If you are under 18, you must have parental or guardian consent to use the App.

3.2 Account Creation

Some features may require account creation (email, social login).
You are responsible for maintaining the confidentiality of your account credentials.
You agree to provide accurate and complete information when creating an account.

3.3 Acceptable Use

You may use Graphinger for personal and commercial graphic design purposes.
You must not misuse the App, attempt to reverse engineer it, or access restricted areas.
You must not use the App to create illegal, harmful, or infringing content.
You must not upload or share content that violates third-party intellectual property rights.

4. User Content

4.1 Ownership of Your Graphics

You retain full ownership of all graphics, designs, branding frames, and images you create using Graphinger.
We do not claim any ownership over your original creations.
Your designs are stored locally on your device and are not uploaded to our servers unless you explicitly choose to share them.

4.2 Templates & Assets

Graphics templates, branding frames, and design elements provided in the App are licensed to you for use within the App.
You may use these templates to create graphics for personal and commercial projects.
You may not redistribute, resell, or sublicense the templates or assets separately from your own designs.

4.3 Content Moderation

We reserve the right to remove any content that violates these Terms or applicable laws.
We may suspend or terminate accounts that repeatedly violate these Terms.

Responsibility: You are solely responsible for ensuring that any graphics you create and share do not infringe on third-party rights (trademarks, copyrights, etc.).

5. AI-Powered Features

Graphinger includes AI-powered features to enhance your creative workflow:

AI Photo Prompts: Generate creative prompts for social media, ads, and branding.
Smart Branding Frames: AI-assisted placement suggestions for logos.
Event-Based Suggestions: AI recommends relevant templates based on trends.

5.1 AI Usage Terms

AI features are provided "as is" for creative inspiration.
We do not guarantee the accuracy, originality, or suitability of AI-generated suggestions.
You are responsible for reviewing and modifying AI-generated content before use.
AI prompts may be processed through third-party AI service providers.

AI Transparency: Graphinger uses AI to assist your creativity. AI-generated suggestions are based on patterns and may not always be unique. Always review content before publishing.

6. Permissions & Data Usage

Graphinger requests the following permissions to provide core functionality:

INTERNET / ACCESS_NETWORK_STATE: To load graphics templates, AI prompts, and display ads.
POST_NOTIFICATIONS: To send daily graphics alerts and event notifications (opt-in only).
VIBRATE: For haptic feedback during interactions.
AD.ID: For serving relevant advertisements.

No Storage Permission: Graphinger does not request storage permissions. All graphics and designs are saved in the app's private storage. Sharing graphics uses Android's built-in share system.

7. Intellectual Property

All App design, UI, branding, code, and original content (excluding user-created graphics) belong to Codeleka.
Graphics templates, branding frames, and design assets are protected by copyright and are licensed, not sold, to you.
You may not copy, modify, distribute, sell, or lease any part of the App or its content without our explicit permission.
"Graphinger" name, logo, and branding are trademarks of Codeleka.
Third-party trademarks and AI tools mentioned are property of their respective owners.

8. Advertising & Third-Party Services

8.1 Advertising

The App may display ads from third-party networks including Google AdMob and Meta Audience Network.
Ad networks may collect data according to their own privacy policies.
You can opt out of personalized advertising in your device settings.

8.2 Third-Party Services

Graphinger may integrate with third-party AI processing services and analytics tools.
Links to external websites or tools accessed through the App are governed by their own terms.
We are not responsible for third-party content, services, or data practices.

9. Limitation of Liability

Graphinger is provided on an "as is" and "as available" basis without warranties of any kind.
We do not guarantee uninterrupted, error-free, or secure access to the App.
We are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the App.
We are not responsible for the accuracy, reliability, or suitability of AI-generated content.
We are not liable for any loss of data, graphics, or designs created within the App.
You acknowledge that your use of the App is at your sole risk.

Maximum Liability: To the extent permitted by law, our total liability shall not exceed the amount you paid to use the App (if any) or $10 USD, whichever is greater.

10. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes in our practices or legal requirements. Continued use of Graphinger after changes means you accept the updated terms. We will notify you of material changes through the App or via email.

11. Termination

We may suspend or terminate your access to Graphinger at any time, without notice, for conduct that violates these Terms or for other reasons that may harm our users or business. Upon termination, your right to use the App will cease immediately.

You may delete the App at any time to remove all locally stored data from your device.
